2) Overview: What data we process

(1) Technical data: IP address, browser/device data, operating system, date/time, referrer URL, visited pages, log data.

(2) Account and contract data: Name, company, address, email, phone number, customer number, login data, booked services, billing and contract data.

(3) Communication data: Contents of inquiries, support messages, emails, as well as messenger messages (WhatsApp/WeChat/Telegram), if you choose this channel.

(4) Payment data: Transaction data, payment status and depending on the payment method, additional data (e.g., IBAN for direct debit). Card/payment details are typically processed directly by the payment service provider.

(5) Marketing/analytics data: Cookie IDs, device IDs, event data (e.g., page views, clicks, conversions), if you consent.

3) Purposes and legal bases

(1) Website and app operation, security, stability, error analysis: Art. 6 Para. 1 lit. f GDPR (legitimate interest) and, if applicable, Art. 6 Para. 1 lit. b GDPR (contract/pre-contractual).

(2) Customer account, contract processing, provision of hosting/CMS/services, billing, support: Art. 6 Para. 1 lit. b GDPR.

(3) Fulfillment of legal obligations (e.g., retention): Art. 6 Para. 1 lit. c GDPR.

(4) Statistics, marketing, conversion measurement, retargeting: Art. 6 Para. 1 lit. a GDPR (consent).

(5) You can withdraw your consents at any time. The withdrawal will take effect for the future.

7) Communication via email, WhatsApp, WeChat, Telegram

(1) Communication via email: Processing your contact details and message content for processing.

(2) Messenger (WhatsApp, WeChat, Telegram): Used only if you choose this channel or respond via it. Account IDs, phone numbers, metadata, and content may be processed.

(3) Note: Messenger services are third-party providers. Data processing may occur outside the EU/EEA. If you do not want this, please use email.

8) Payment processing (PayPal, GoCardless, Stripe)

(1) For payments, we use PayPal, GoCardless, and Stripe. For this, we forward necessary data to the chosen payment service provider (e.g., name, amount, transaction data, payment status).

(2) Purpose: Payment processing, fraud prevention, accounting.

9) Google services (Analytics, Tag Manager, Ads, reCAPTCHA, YouTube, Fonts)

(1) Google Analytics: Measuring usage (e.g., page views, events). Legal basis: Consent (Art. 6 para. 1 lit. a GDPR).

(2) Google Tag Manager: Managing website tags. The Tag Manager itself may not require cookies but can load tags that use cookies/tracking. Legal basis for tracking tags: Consent (Art. 6 para. 1 lit. a GDPR).

(3) Google Ads (including conversion tracking/remarketing, if activated): Success measurement and marketing. Legal basis: Consent (Art. 6 para. 1 lit. a GDPR).

(4) Google reCAPTCHA: Protection against abuse (bots/spam) in forms and logins. Legal basis: Art. 6 para. 1 lit. f GDPR (security interest). If consent banner/device rules require it, we will load reCAPTCHA only after consent.

(5) YouTube: When videos are embedded, connection and usage data is transmitted to YouTube/Google as soon as you activate the video. For external media, we use consent management if available. Legal basis: Consent (Art. 6 (1) lit. a GDPR), if controlled via consent.

(6) Google Fonts: If fonts are loaded from Google servers, your IP address will be transmitted to Google. Legal basis: Consent (Art. 6 (1) lit. a GDPR), if controlled via consent.

(11) bluetronix App (iOS and Android)

(1) When you use our bluetronix App, we process – depending on functions – account/login data, contract data, technical app data (device, operating system, app version), log/diagnostic data, and possibly push tokens (for push functions).

(2) Purposes: App operation, account access, security, support, troubleshooting.

(3) Legal bases: Art. 6 (1) lit. b GDPR (contract/initiation) as well as Art. 6 (1) lit. f GDPR (security and stability interest). Tracking/marketing within the app only after consent (Art. 6 (1) lit. a GDPR), if used.

(12) Hosting, CMS, Data Processing Agreement (DPA)

(1) If you operate your own websites/apps through our systems and process your users' personal data, you typically remain the controller. We then act as a processor.

(2) In these cases, we will provide a data processing agreement (DPA) upon request.

(12a) Developer Network (Partner Developers)

(1) If you request or commission services through our developer network, we will pass on the data necessary for the offer, coordination, and implementation to the partner developer you have selected.

(2) In particular, the following data may be processed: Name, email address, phone number (if provided), project data (e.g., requirements, screenshots, files), communication content, and possibly access credentials, where they are essential for implementation.

(3) The purpose of processing is to initiate and implement the project, quality assurance, and billing through bluetronix.

(4) Legal basis: Art. 6 (1) lit. b GDPR (contract/initiation). As far as we carry out quality assurance and abuse prevention, additionally Art. 6 (1) lit. f GDPR (legitimate interest).

(5) Partner developers may operate worldwide. If processing takes place outside the EU/EEA, the notes on third-country transfers and protective measures in Section 14 apply.

13) Server Locations and Data Processing by Region

(1) We operate server locations by region. Depending on the product booked, performance requirements, or location choice, data may be processed at the following locations:

14) Third Country Transfers and Safeguards

(1) When using third-party providers (e.g., Google/Meta/TikTok/LinkedIn/PayPal/Stripe) or server locations outside the EU/EEA, a transfer to third countries may occur.

(2) We use appropriate safeguards (e.g., EU Standard Contractual Clauses) or adequacy decisions if necessary. If a provider is certified under the EU-U.S. Data Privacy Framework, this may serve as the basis.

15) Storage Duration

(1) We only store data as long as necessary for the purposes of this statement or as long as legal obligations exist (e.g., commercial and tax law retention).

(2) We retain log data for an appropriate duration for security analysis and troubleshooting.

(3) We store consent data for verification and as long as your choice is valid.

16) Your Rights

(1) You have rights to information, correction, deletion, restriction, data portability, and objection to certain processing.

(2) You can withdraw consent at any time. For cookie settings, see Section 4.

17) Right to Complain
